PAYMENT

Payment of the non-refundable deposit is due at the time of booking. Payment for the remainder of the package must be made a week before the session. If the balance is not paid in full by this time, SMP has the right to cancel the shoot with no monies returned.

CANCELLATION
Should the Client need to postpone then the package fee will be applied to the new booking. If the Client cancels and does not rebook, then the package fee will be retained by SMP. If SMP has to cancel the session for reasons beyond their control (death, injury, sickness etc.), their liability shall be limited to a full refund of all monies paid.

PHOTO SESSION
SMP shall be granted creative and artistic licence in relation to the choice of locations, backgrounds and poses used. SMP’s judgement on photographic style and the number of photographs taken shall be deemed correct. Some photographs may not be possible due to changes of the weather and the availability and willingness of subjects. SMP will do their best to honour requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement. If for any reason SMP experiences a lack of co-operation from the client or associated parties and images are unable to be taken through no fault of the photographer, SMP cannot be held liable.

YEARLY BRAND SESSION
Contracts for yearly brand sessions run for 12 months. After 12 months this will fall into a rolling quarterly contract. The contract cannot be broken within the first 12 months, after that a month’s notice is required. Payment is made quarterly.

RETOUCHING OF IMAGES
Images are individually corrected for colour balance, exposure, contrast etc. Light retouching is included. However, extensive retouching is chargeable as an extra service. Extensive retouching means correcting various elements in an image such as litter, background distractions etc and minor physical flaws (acne, removal of stray hairs etc).

DELIVERY
SMP aims to have the Client’s images delivered within two weeks of the photo session, but during busy periods this timeframe may be extended. Bespoke products may take longer depending on supplier lead times. Any delay in payment will affect the delivery period. Digital images are delivered to the client via digital transfer.

MARKETING
The Client grants SMP the right to use a Client’s images for advertising and promotion in various media (including SMP’s own website), entry in photographic contests or art exhibitions, editorial use, for the creation of samples or for display within or on the outside of any studio used by the SMP.

If SMP wishes to use any of the Client’s images for commercial purposes where payment is sought or received, such as the sale of images to photographic libraries, SMP will not do so without first obtaining the written permission of the Client.  

COPYRIGHT
SMP will own the copyright in all images created. RAW images will remain the property of SMP and cannot be transferred to the Client or purchased. The Client is obtaining images for personal/ own business use only, including for social media, website, blog and print. They may not be published with external companies or sold without the express written permission of SMP.

The Client may not alter, add to or manipulate an image by any means, except to add text or graphics to images. Permission to reproduce (e.g. scanning, copying, printing) an image is granted to the Client by SMP only when digital images are purchased. 

REFUNDS
If you are unhappy with any products from SMP every effort will be made to rectify the issue. Incorrectly supplied items and items of poor quality can be returned and will be replaced on return of the item. The Client must report the issue in writing within 48 hours of receipt. Returns will not be considered for incorrectly ordered items or items ordered in error. No return, exchange or refund is available on any item once the order has been placed. For digital files no refunds are available once they have been received.

Please note that all computer monitors are calibrated differently and the final print may differ slightly in colour or brightness from what you see on the monitor. SMP takes no responsibility for prints that are ordered by the Client from a low quality printer - to maintain the quality of the image use a reputable printing company.

LIABILITY
In the unlikely event of total photographic failure, injury or sickness beyond SMP’s control, their liability shall be limited to a full refund of all monies paid. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of SMP. In the event SMP fails to perform for any other reason, SMP shall not be liable for any amount in excess of the retail value of the Client’s order.

The purchase of digital files releases SMP from any liability due to future loss or damage of the images and from any obligation to maintain copies of any digital file, image or photograph. It is the responsibility of the Client to ensure adequate back up of digital files.

PRIVACY & DATA PROTECTION
SMP collects certain personal information from the Client in connection with the photo session (e.g. name, email address, home address, phone number). SMP will only use personal information for the purposes of undertaking the services booked by the Client and creating and delivering images and products. Personal information and photographs may be provided to selected partners for retouching services and for the purposes of creating products. SMP will store the Client’s personal information and photographs on their own system but will not disclose any personal information to a third party without the Client’s prior consent.
